Makati City Mayor Abigail Binay can now rest easy, as the Commission on Elections (COMELEC) dismissed the poll protest filed against her by losing mayoralty candidate Romulo "Kid" Peña Jr.
In an 11-page decision released yesterday, the COMELEC's 1st Division explained that the complaint was junked for "insufficiency in form."
The Philippine Star notes that "Peña failed to prove that election fraud affected the results of the Makati mayoral race last May."
The COMELEC resolution points out: "The complainant did not indicate the precincts where supposed errors in the scanning of the ballots by the vote counting machines (VCMs) took place. He also failed to prove allegations that the ballots were prepared and fed into the VCMs by people other than the voters. The poll body cannot guess where in the 287 clustered precincts being protested these anomalies happened."
